Welcome to Plumbsafe! These Terms and Conditions (“Terms”) govern your use of the Plumbsafe mobile application (“App”) and website (“Site”). By accessing or using Plumbsafe, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. Acceptance of Terms

By creating an account, accessing, or using Plumbsafe, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any future modifications. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of Plumbsafe after any changes constitutes your acceptance of the revised Terms.

2. Eligibility

Plumbsafe is designed for individuals who seek reliable and accessible plumbing solutions. To ensure a safe and compliant environment for all users, the following eligibility criteria apply:

2.1 Age Requirement

• Minimum Age: Plumbsafe is intended for users who are at least 18 years old. By accessing or using Plumbsafe, you represent and warrant that you are at least 18 years of age.
• Verification: We reserve the right to request proof of age at any time to verify that you meet our age requirement. Failure to provide proof of age may result in suspension or termination of your account.

2.2 Legal Capacity

• Competency: By using Plumbsafe, you affirm that you have the legal capacity to enter into a binding agreement with us. This means you have the mental capacity to understand, agree to, and comply with these Terms and Conditions.
• Legal Restrictions: You represent and warrant that you are not prohibited from using Plumbsafe by any applicable laws, regulations, or policies. This includes, but is not limited to, any restrictions imposed by your jurisdiction or any terms of service from other platforms you use in conjunction with Plumbsafe.

• Accuracy: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. This includes your name, age, location, and email address.
• Identity: You may not impersonate any person or entity, or falsely state or otherwise misrepresent your identity or affiliation with any person or entity. Plumbsafe reserves the right to refuse registration or cancel a user account if we believe you have misrepresented your identity.

2.4 Compliance with Terms

• Adherence: You agree to comply with these Terms and all applicable local, national, and international laws and regulations. You acknowledge that any breach of these Terms may result in the suspension or termination of your account and access to Plumbsafe.
• Prohibited Activities: You agree not to engage in any activity that interferes with or disrupts the services provided by Plumbsafe, or any servers or networks connected to the service. This includes, but is not limited to, hacking, spamming, or violating any security measures.

2.5 Geographic Restrictions

• Availability: Plumbsafe is available to users worldwide, but we make no representations that our services are appropriate or available for use in all locations. Accessing Plumbsafe from territories where the service or any of its features are illegal is prohibited.
• Export Compliance: You agree to comply with all applicable laws regarding the transmission of technical data exported from your country of residence and the country in which you are located.

2.6 Organizational Use

• Entity Representation: If you are using Plumbsafe on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, the terms “you” and “your” will refer to both you as an individual and the entity you represent.
• Organizational Accounts: For entities requiring multiple user accounts, each user must individually comply with these Terms. The entity is responsible for ensuring all users associated with the organizational account adhere to these Terms.

2.7 Ineligibility

• Previous Violations: Individuals who have previously been suspended or banned from using Plumbsafe for violating these Terms or any applicable laws may not create a new account or use the service.
• False Information: Providing false, misleading, or incomplete information during the registration process or while using Plumbsafe may result in the immediate termination of your account.

3. Account Registration

To access and use certain features of Plumbsafe, you are required to create an account. This section outlines the detailed process and requirements for account registration, including your responsibilities and obligations as a registered user.

3.1 Account Creation

• Registration Process: To create an account, you must complete the registration process by providing the required information, including but not limited to your name, age, location, and email address. You may also be required to create a username and password.
• Profile Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. This includes updating your profile information promptly if there are any changes.

3.2 Account Security

• Password Protection: You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree not to disclose your password to any third party.
• Account Responsibility: You are responsible for all activities that occur under your account. If you become aware of any unauthorized use of your account, you agree to notify us immediately.
• Security Measures: We implement security measures to protect your account and personal information. However, we cannot guarantee absolute security, and you acknowledge that your account is subject to risks inherent in internet-based services.

3.3 Use of Your Account

• Personal Use: Your account is for your personal use only. You may not share your account with others or allow others to access or use your account.
• Prohibited Actions: You agree not to use your account for any illegal or unauthorized purpose, including but not limited to, engaging in fraudulent activities, distributing malware, or infringing on intellectual property rights.
• Compliance with Terms: You agree to comply with all applicable laws and regulations and with these Terms when using your account.

3.4 Account Termination

• Voluntary Termination: You may terminate your account at any time by following the instructions provided in the app or by contacting our support team. Upon termination, you will no longer have access to your account or any data associated with it.
• Involuntary Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice and without liability, for any reason, including but not limited to, if we believe you have violated these Terms, provided false information, or engaged in fraudulent or harmful activities.
• Effect of Termination: Upon termination of your account, your right to use Plumbsafe will immediately cease. We may delete or deactivate your account and all related information, files, and content associated with your account. We will not be liable to you or any third party for termination of your account or loss of related information.

3.5 Account Recovery

• Forgot Password: If you forget your password, you can reset it by following the password recovery process provided in the app. You will need to provide your registered email address to receive password reset instructions.
• Account Suspension Appeal: If your account is suspended or terminated, you may contact our support team to appeal the decision. We will review your appeal and notify you of our decision. Our decision will be final and binding.

3.6 Multiple Accounts

• Single Account Limitation: You are allowed to create only one account for personal use. Creating multiple accounts for the same individual is prohibited unless explicitly permitted by Plumbsafe for specific purposes, such as organizational accounts.
• Organizational Accounts: For organizations, each member must have an individual account linked to the organizational account. The organization is responsible for managing and ensuring compliance with these Terms by all its members.

3.7 Account Information Management

• Updating Information: You agree to keep your account information up-to-date and accurate. You can update your information through the account settings in the app.
• Data Privacy: Your account information is governed by our Privacy Policy. By creating an account, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

4. User Conduct

You agree to use Plumbsafe in a manner that is lawful, respectful, and consistent with these Terms. You agree not to:

• Use Plumbsafe for any illegal or unauthorized purposes
• Post or transmit any content that is harmful, offensive, or violates the rights of others
• Interfere with or disrupt the operation of Plumbsafe or its servers
• Attempt to gain unauthorized access to any part of Plumbsafe or its systems

5. Services and Features

5.1 Tutorials

Plumbsafe provides tutorials with real-time situations to help users overcome plumbing challenges. These tutorials are for informational purposes only and are not a substitute for professional advice.

5.2 Code Book

Plumbsafe includes a searchable International Plumbing Code Book. While we strive to provide accurate and up-to-date information, we do not guarantee the completeness or accuracy of the codes and regulations.

5.3 Feedback

Users can provide feedback on the app and suggest changes to the user interface. While we value your feedback, we are not obligated to act on it or provide any compensation.

5.4 In-App Purchases

Plumbsafe offers premium features through in-app purchases. By making an in-app purchase, you agree to pay the specified fees and charges. All sales are final, and no refunds will be issued unless required by law.

5.5 Chat/Messaging

Users can communicate with the admin using the in-app chat/messaging feature. All communications are subject to monitoring and moderation to ensure compliance with these Terms.

5.6 Push Notifications

Plumbsafe may send you push notifications for updates, announcements, and other information. You can manage your notification preferences in the app settings.

6. Super Admin Features

The Super Admin interface provides additional features for managing the app, including:

• User account management
• Payment and subscription management
• Report generation and management
• Content management
• User role and permission management
• Sending push notifications

7. Intellectual Property

All content, including text, graphics, logos, and software, is the property of Plumbsafe or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

8. Privacy Policy

Your use of Plumbsafe is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using Plumbsafe, you agree to the terms of our Privacy Policy.

9. Disclaimer of Warranties

Plumbsafe is provided on an “as-is” and “as-available” basis. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Plumbsafe and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. Our total liability to you for any claims arising from your use of the app is limited to the amount you paid us, if any, for access to and use of the app.

You agree to indemnify, defend, and hold harmless Plumbsafe and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your use of the app or violation of these Terms.
